WARREN B. BRAMS: Estate planning is the process of directing who will receive your worldly goods when you die and who should be in charge of facilitating that process. Any competent adult can establish an estate plan. The purpose of estate planning is to direct who will receive your assets rather than the court making that decision. The first step is to determine the goals that you want to achieve by your estate plan. In a trust, we place conditions on the passage of title to your assets. It's particularly appropriate when your assets may pass to a child or young person. It also may be appropriate to achieve other goals, such as tax savings or avoiding the cost of probate. A will is one way of passing title to your assets. It is appropriate for everyone to have a will. There are many ways to pass title to your assets. Your goals will help determine the way in which your estate plan is developed.
