WARREN B. BRAMS: Incapacity planning is a process of delegating your rights to make decisions concerning your healthcare or legal or financial affairs to another person so that a guardianship is not required if you become incapacitated. Incapacity planning is appropriate for everyone because none of us knows when we may become incapacitated. Everyone should know that unless you have done incapacity planning, if you become incapacitated, a legal guardianship will be required. The benefits of incapacity planning are that your affairs will remain private and that your agent will not be required to account to the court. In addition, it gives you the peace of mind that the person whom you have selected rather than someone who the court has selected will make those decisions for you. We encourage our clients when preparing documents to choose a successor in the event that the first chosen person is not available. Incapacity planning documents can be changed at any time, as long as the person is competent to do so.
